    • Will of Allen Garrett

      In the Name of God Amen I Allen Garrett of Frederick County in the State of
      Maryland Farmer, being verry Weak and in a low State of health but of Sound
      disposing mind and memory do make and Ordain this my last Will and Testament in
      manner and form following that is to say I Give and recommend my Soul into the
      Hands of Almighty God that gave it And my Body to the Earth from whence it
      came to be decently Interred at the discretion of my Executors And Touching such
      Worldly Estate withit (hath) Pleased God to bless me with I Will and Bequeath
      in the following Manner and form
      Item I Give and Bequeath to my beloved Son John Philpott Garrett part of a
      Tract or Lott of Land No 22 it being Part of the Maryland Tract lying and being
      in Frederick County in the State of Maryland and now under lease to Charles
      Philpott with Ten Acres of well Timbered Land to be Chose by my said Son out of
      any Part of my Land And Also Thirty Pounds Specie to be Levied and paid him
      out of my Estate when he Arrives at the Age of Eighteen And after the
      Expiration of Charles Philpotts Lease its my Will and Desire that the said Land may not
      be tended or Tented to any Person whatsoever or the timber by any means
      distroyed thereon And when my Said Son Arrives at the Age of Eighteen its my Will
      and desire that he Take Possession of the said Land

      Item I give and Bequeath to my Beloved Son Horatio Garrett Part of the Land I
      am Possessed with on the South Side of the Main Road leading from Harper’s
      ferry to Frederick Town. Beginning at the falls of Potomak The falls being a
      little above the Bounded Tree of the Merryland Tract~Also thirty Pounds Specie
      to be Levied and paid him when he Arrives at the Age of Eighteen at which time
      he is to Take Possession of the said Land

      Item I Give and Bequeath to my Beloved Wife Mary Barton Garrett the Remainder
      Part of my Land it being the Place where I now live and being Part of the
      Maryland Tract aforesaid during her life And after her Decease to be equally
      Divided Between my two Sons John Philpott Garrett and Horatio Garrett Also a
      Negro fellow Called Yarrow together with all my Personal Estate~~Lastly I do make
      and Constitute Mary Barton Garrett my said Wife Executrix of this my last Will
      and testament and I do hereby Utterly disallow Revoke and Disannull all and
      every other Testaments and Wills by me in any Wise before Named Willed and
      Bequeathed Ratifying~ and Confirming this to be my last Will and Testament~
      In Witness Whereof I have hereunto set my hand and Seal this
      Seventeenth day of January 1784

      Signed Sealed Published and Pronounced by the said Allen Garrett as his Last Will and Testament in Presence of us who have hereunto Subscribed

      Frederick County March 20th 1784 Then came Mary Barton
      Garrett and made Oath that the aforegoing Instrument of
      Writing is the True and Whole Will and Testament of Allen
      Garrett late of Frederick County Deceased that hath come to
      her hands or Possession and that she doth not know of any
      Other~~~

      Frederick County May 20th 1784 Then Came Joseph Gwinn
      and Charles Thomas Philpott two of the Subscribing Witnesses to the
      aforegoing last Will and Testament of Allen Garrett
      late of Frederick County Deceased and made Oath on the holy
      Evangelists of Almighty God that they did see the testor
      therin Named Sign and Seal this Will and that they heard~
      him Publish Pronounce and Declare the same to be his
      Last Will and Testament that at the time of this so doing
      he was to the best of their Apprehensions of sound and disposing
      memory and Understanding and that they respectively~~~
      Subscribed their Names as Witnesses to this Will in the
      Presence and at the request of the Testator and that they
      did Also see Samuel Prather the Other Subscribing~~
      Witness Subscribe his Name as a Witness thereto in the
      Presence and at the request of the Testator and in the
